LO2: Legal and Ethical

 Legal and Ethical

Legal - i.e. Abide by law i.e. Copyright, libel

Ethical - Text and Visuals are morally appropriate (How you represent someone).

Legal

Obscene Publications Act

Criminalizes the publications of an obscene article if it tends to deprave or corrupt people. It is illegal to publish content that may negatively influence readers. For my magazine, the type of audience that my product is targeted to is ages 18 and up, due to the explicit references and titles of songs within their albums this would only be suitable for older ages. My magazine isn't targeted at any specific gender due the band having both male and female musicians which creates a bigger target audience for my magazine as it appeals to both genders equally. However, you could argue that this magazine is targeted towards females as the female within the band appears to be more dominant because of her being the main one who sings and gets featured within the music videos. For lifestyle, my product would be aimed at people who have 60% of their disposable income because of the gigs that the band does all around the country, leaving people who are interested having to buy tickets and travel expenses to watch. Additionally, fans may also buy albums, vinyl's and merchandise will need this disposable income as they won't be cheap. However, one thing that my audience could be influenced by the use of language used within these artists and how stereotypically. When looking at my client, I will adhere to this law by censoring explicit language within my magazine so that no harmful content is promoted and encouraged. I will also make sure that the images of my artists don't include explicit gestures as this may encourage my target audience to do the same gestures. Furthermore, I will abide by this law by being mindful of where I take these images of my artists as I would not want to promote mosh pits due to them being very dangerous.

Libel Law

Illegal for people to publish harmful and slanderous content about an individual of which isn't true. I will abide by this law by including text that was spoken by them as it will stay true to them and won't appear as if I've changed up their words and possibly cause slander and ultimately damage their reputation. I will show my chosen artist what I have written about them so that they can check and agree for me to distribute it to the public. Another example of what I can do to abide by this law is by keeping my representations true to them when it comes to images as I want to keep them age appropriate and make sure that they aren't represented in a explicit and sexual way as that will appear to the harmful and untrue towards their image and overall representation to what they do. I will have to check these images before I use them as I don't want to misrepresent my client in a negative manner. I will make sure to include whatever features my client has stated for me to add as this will keep my magazine truthful and honest that will follow with what my artist has said.

Copyright

1988 Copyright is the legal act that protects creators work from being stolen from other people. However if people want to use creators work to merge it into theirs, they will need to ask permission from the original artist or will have to pay a sum of money in order to use it. People who don't follow this could suffer getting in trouble with the law and having to pay a big sum of money. Overall allows creators and producers to have their intellectual property/products protected and for it not to be used without permission. One example that I will adhere to this copyright law is by taking my own images of my chosen artist (The Sewer Cats)  performing so that my images are original and I will not need to ask permission from other people. This will help me avoid the copyright law in the future as they are my own images of my music artist and therefore I will not need to gain permissions to use others intellectual peoples property. Another example of how that I will adhere to this law is by gaining permissions from people to use their intellectual property to place within my magazine. Since my magazine is about a music band, I may want to promote their other albums and to do this I will need to go onto the internet and find and image of their album covers. However, since this product was made by someone else, I will need to gain permissions from the original creator so that I can use their images. If they say yes, I will need to get them to sign a release and consent agreement to show that they have given me permission to use their intellectual property. Finally, the last example of how I can adhere to this law is by gaining my research and information by an interview. Doing an interview allows me to gain fresh and new information that nobody has been told, which means that I will not need to gain permissions to use someone else's research within my magazine as I have already got my research first hand. However, if I want an interview to happen with my chose artist, I will need them to sign a release and consent form so that they give me permission to use their words within my magazine. Overall, doing an interview allows me to gain my own personal and direct research that isn't second hand and the interviews allow my information and research to be up to date.

Laws of Contempt

Laws of Contempt means that it is a criminal offence (against the law and leads to consequences) to print anything within my magazine that could negatively influence a court case. This meaning that the outcome of the magazine will change due to what I have placed within my magazine. This law prevents magazines from publishing anything that is too sensationalist about a criminal case.

This here is an article created by the BBC talking about how the venue 'The Leadmill' owns the Sheffield City Council £10,000 so then this leads to the tenants 'Electric Group' evicting the pervious owners and running the business themselves. The Leadmill is know for hosting indie music artists for people to come and watch, which links with my magazine as The Sewer Cats are small indie artists that performed within a venue within Sheffield.

An example of how this can affect my magazine is by openly stating my opinion about this court case within the magazine itself when promoting or including other venues. My opinion of this case could potentially lead to people of the jury seeing my opinion and changing their views upon the incident which is illegal. One way that I can adhere to this rule is by not including my opinion upon the case within the magazine and instead just state the name of the venue without giving any personal opinions to sway jury decisions. 

However, a stereotypical example of how things like this can affect my magazine is the use of drugs. Drugs are stereotypically associated with rock bands and punk rock music so this could affect my magazine if there was a trail going on in court about drugs and I gave my opinion on it. I would ultimately be inappropriate to include within a music magazine. I will adhere to this rule within my magazine by not mentioning any type of recreational drug use as this will not influence or bring up the topic of controlled substances. Another way that I will adhere to this law is by sticking to the facts within my artist and not mentioning any of my opinions of the misuse of drugs within this type of genre of music. 

Another example of how this can affect my magazine is the stereotypical theme of violence that is promoted within rock music. People being exposed to such violent songs within a venue  can cause people to complain and possibly get the venue sued for allowing such artists to perform such violent songs. This could link to any violent court cases that ha shaped with music within the past which is bad as this could affect this law and get my magazine taken down. I can prevent this by not including information about the violence within the songs and not stating my opinion of the situation. If I wanted to report on this however I would need to state the facts instead of my opinion.

Ethical 

Ethical within media is the concern of moral principles and conduct expected from of media professionals and organisations. These concerns are typically about the potential harm that media can cause  as well as the responsibility for media to be truthful, accurate and fair. 

One ethical issue that I need to address when creating my magazine is making sure that their is censors within my magazine due to how my artists swear within their songs and the title of their songs have swearing in them. this is due to the genre of my music band stereotypically having swearing within there music and everyday language. I can adhere to this by either censoring the offensive language that they have used within their songs or the language that they have used within the interview. This will lead to people not being exposed to bad language as it will be censored and it will add to the prevention of swearing. However, my magazine is targeted towards a target audience age group of 16 and above, I will still need to censor my language as once my magazine gets released, anyone at any age can access my magazine. 

Another ethical issue that will need to be addressed within my magazine is the use of gender within my genre and how my magazine defeats the stereotype of the male taking the lead within the bad. Stereotypically, within rock and punk rock bands men are usually the leads within the band with woman either not even being in the band or they are an included within a small piece of the band. My magazine defeats this stereotype as there is a mix of gender within my band, having a male and a female that both play instruments and contribute equally to the band. However, you could argue that the woman within the band is the more dominant as she is the one who sings the songs and she is also the one who spoke the most within the interviews, which is hinting at that she possibly knows a lot about the industry itself too, which defeats that stereotypical image of males being the more dominant ones in band. I will adhere to ethical within my magazine by making the woman within my band be included in the front cover shot as well as having images of her being presented suitably within the magazine. This will help defy that stereotype of a male being the lead within the band as the magazine will be focused on a woman who plays a huge roll within the band while equally presenting the male of the band too, showing equality of gender within my magazine.

Finally, the last ethical issue that I want to address within my magazine is the stereotype within my genre and how they use drugs. Stereotypically, artists within the rock and punk rock music industry write and sing about songs which promote the use of illegal substances towards its audience which could negatively impact my magazine. To adhere this, I will avoid the topic of talking about the use of drugs within my magazine and I will also include a warning within my magazine stating for the audience to be 'drink responsibly' or to 'not do drugs' as this will influence people who are reading my magazine not to do drugs and this will show that my magazine defeats the stereotype of promoting illegal substances and drinking to its audiences. Overall, I can prevent this ethical issue by not promoting the use of drugs within my magazine like most others do within my genre and I will include warnings to my audience to beware of these substances.
